Nexus Kairos LLC ("Nuva", "we", "us", or "our") operates the Nuva mobile application and website (https://nuva-ai.app) (together, the "Service").

This Privacy Policy explains:

  • What personal information we collect
  • How we use and share it
  • How long we keep it
  • Your rights and choices

By using Nuva, you agree to the practices described in this Policy. If you do not agree, please do not use the Service.

1. Information We Collect

We collect information in the following categories:

1.1 Account Information

When you create a Nuva account, we collect:

  • Email address
  • Password (stored as a secure hash)
  • Optional profile details (e.g., name, avatar, preferred language level)

1.2 Voice & Audio Data

Nuva is a voice-first English learning app.

When you practice speaking:

  • We collect and store your voice recordings (audio files) in secure cloud storage (e.g., Google Cloud Storage).
  • We generate and store transcripts of your speech.
  • We generate derived metrics and labels, such as pronunciation scores, fluency scores, detected errors, or other analytics about how you speak.
  • We use this information to provide feedback, show you your history and progress, and improve Nuva's features and AI models.

Unlike purely transient processing, audio is stored for a limited period as described in the "Data Retention" section below.

1.3 Usage & Learning Data

We collect information about how you use Nuva, including:

  • Session duration and timestamps
  • Features you use (e.g., assessment mode, free talking, roleplay topics)
  • Learning progress (scores, levels, vocabulary studied, mistakes you make often)
  • In-app events (e.g., completed session, opened paywall, changed settings)

This helps us personalize your experience, track your progress, and improve the product.

1.4 Device & Technical Information

We automatically collect:

  • Device type and operating system
  • App version
  • IP address (used for security, approximate location, and fraud prevention)
  • Crash logs, performance data, and diagnostic information

1.5 Payment & Subscription Information

Nuva subscriptions and in-app purchases are processed by:

  • Apple App Store (Apple ID)
  • Google Play Store (Google account)

We do not store your full payment card number. However, we receive limited subscription-related information from the app stores and our subscription infrastructure (e.g., RevenueCat or similar), such as:

  • Product IDs (e.g., monthly, 3-month, annual plan)
  • Subscription status (active, expired, in trial)
  • Renewal and expiration dates
  • Country or region
  • Anonymous transaction identifiers needed to confirm entitlement

We use this information to determine which features you can access and to manage your subscription.

1.6 Cookies & Similar Technologies (Website)

On our website, we use cookies and similar technologies to:

  • Remember your preferences
  • Understand how visitors use the site
  • Measure the effectiveness of marketing and product pages

We may use Google Analytics or similar tools to collect aggregated information about web traffic (pages visited, time on page, referring URLs, etc.). These tools may set their own cookies.

You can usually instruct your browser to refuse all cookies or to indicate when a cookie is being sent. If you disable cookies, some parts of the website may not function properly, but the core app experience will still work.

1.7 Analytics, Ads & Attribution

We use analytics data to understand feature usage, performance, and user flows.

We may work with advertising or attribution partners in the future to measure campaigns and, if we introduce ad-supported features, to show relevant ads.

If we introduce third-party ads, we will:

We do not sell your personal information.

  • The content of your message and any attachments
  • Metadata like time, date, and basic technical context

2. How We Use Your Information

We use your information to:

  • Run live voice conversations and assessments
  • Generate feedback, scores, transcripts, and learning recommendations
  • Display your session history and progress

Personalize your experience

  • Suggest topics, difficulty levels, or exercises that match your level and goals
  • Adjust feedback and prompts based on your past behavior and performance

Maintain security and prevent abuse

  • Detect suspicious activity or misuse
  • Prevent fraud or unauthorized access

Analyze and improve the Service

  • Understand which features are used or not used
  • Improve speech recognition, scoring models, and AI tutor behavior
  • Debug issues and improve performance

Communicate with you

  • Service messages (account, security, subscription status, changes to legal terms)
  • Product updates and marketing messages (where permitted and with opt-out options)

Comply with legal obligations

  • Respond to lawful requests from authorities
  • Maintain appropriate business records

We do not use your data to provide third-party advertising outside of Nuva's ecosystem and we do not sell your personal data.

3. Legal Bases (EEA/UK Only)

If you are in the European Economic Area or the UK, we process your personal data under one or more of the following legal bases:

  • Performance of a contract – to provide Nuva to you and perform our agreement (e.g., running sessions, handling subscriptions).
  • Legitimate interests – such as improving the Service, preventing fraud, and ensuring security. We consider your rights and interests and take steps to minimize impact (e.g., using aggregation and pseudonymization).
  • Consent – for certain analytics, cookies, marketing communications, or other processing where local law requires consent. You can withdraw consent at any time through app settings or by contacting us.
  • Legal obligation – where processing is necessary to comply with applicable law (e.g., tax, accounting, regulatory obligations).

4. Sharing of Information & Service Providers

We share your information with third parties only in these situations:

4.1 Service Providers

We work with trusted vendors to operate Nuva, including (examples):

  • Cloud infrastructure & storage (e.g., Google Cloud, Firebase)
  • Speech recognition, LLMs & AI feedback (e.g., OpenAI, Deepgram, ElevenLabs, Lemonfox, or similar providers)
  • Real-time voice and networking (e.g., LiveKit or similar)
  • Analytics & crash reporting (e.g., Google Analytics, PostHog, crash reporting SDKs)
  • Subscription & payment infrastructure (e.g., Apple, Google, RevenueCat or similar)
  • Email and support tools (e.g., transactional email services, helpdesk tools)

These providers:

  • Only access the data needed to perform services on our behalf
  • Are contractually required to protect your data and use it only as instructed by us

4.2 Advertising & Attribution Partners (If Used)

If we introduce ad-supported features or run marketing campaigns, we may share limited device and usage data with advertising or attribution partners to:

  • Measure campaign performance
  • Prevent fraud
  • Show relevant (not random) ads

We will not share raw audio recordings or transcripts with ad networks for advertising purposes.

4.3 Business Transfers

If Nuva is involved in a merger, acquisition, financing, or sale of all or part of our business, your information may be transferred as part of that transaction. We will take steps to ensure the recipient continues to protect your information consistent with this Policy.

4.4 Legal Requirements & Safety

We may disclose information if we believe in good faith that it is reasonably necessary to:

  • Comply with applicable laws or legal processes
  • Respond to valid requests from public authorities
  • Protect the rights, property, or safety of Nuva, our users, or the public

5. Data Retention

We keep personal information only as long as reasonably necessary for the purposes described above or as required by law.

In particular:

Voice recordings (audio): Stored in encrypted form. We keep them while your account is active and for a limited retention period (for example, up to 12–24 months) unless you delete them earlier or request deletion. We may anonymize or aggregate audio-derived features and retain those longer for analytics and model improvement.

Transcripts & learning history: Stored while your account is active so we can show your past sessions and progress. We may also apply a retention period (for example, 12–24 months) for detailed transcripts, after which we may delete or anonymize them.

Account data: Kept while your account is active. If you close your account or request deletion, we will delete or anonymize your personal data within a reasonable period (for example, 30–90 days), except where we must keep certain data longer for legal or business reasons.

Analytics & logs: Retained for a limited time (for example, up to 12–24 months) to analyze performance and security, then deleted or anonymized.

If your technical implementation uses different retention periods, adjust the durations in this Policy to match actual practice.

6. Your Rights & Choices

Depending on where you live, you may have certain rights regarding your personal information.

6.1 General Rights

You may have the right to:

  • Access – Request a copy of the personal data we hold about you
  • Rectify – Request correction of inaccurate or incomplete data
  • Erase – Request deletion of your personal data
  • Restrict – Request restriction of certain processing
  • Portability – Request your data in a structured, machine-readable format

You will still receive important service-related emails (e.g., security alerts, subscription notices).

6.3 EEA/UK Residents – Additional GDPR Rights

6.4 California Residents – CCPA/CPRA

If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA/CPRA), including:

Nuva does not sell your personal information as that term is generally understood. If we ever engage in "sharing" under California law (e.g., for cross-context behavioral advertising), we will provide appropriate opt-out mechanisms.

You (or your authorized agent) may submit CCPA requests by emailing founder@nexuskairos.com. We will not discriminate against you for exercising any of your rights.

7. Children's Privacy

Nuva is not intended for children under 13 and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it as soon as reasonably possible.

8. Data Security

We use reasonable and appropriate technical and organizational measures to protect your data, including:

  • Encryption in transit (TLS/SSL)
  • Secure storage of audio and other data
  • Access controls and authentication for internal tools
  • Logging and monitoring for suspicious activity

However, no method of transmission or storage is completely secure. We cannot guarantee absolute security, but we work to minimize risk.

You are responsible for maintaining the confidentiality of your account credentials and for any activity on your account.

9. Recording Third Parties & Responsibility

During your practice sessions, other people (family, friends, roommates, etc.) may be heard in the background.

You are responsible for using Nuva in a way that complies with the laws of your jurisdiction, including any laws that require you to obtain consent before recording others.

By using Nuva, you confirm that you have obtained any required permissions from anyone whose voice or data is captured during your sessions.

Nuva is not responsible for your decision to record or share audio outside of the app.

10. International Data Transfers

We may process and store your information in countries other than the one where you live (for example, in the United States, the European Union, or other locations where our providers operate).

These countries may have data protection laws that are different from those in your jurisdiction. Where required, we use appropriate safeguards (such as contractual clauses) to protect personal data transferred internationally.

11. Changes to This Policy

We may update this Privacy Policy from time to time.

If we make material changes, we will update the "Last updated" date and provide notice in the app or by email where appropriate.

Your continued use of Nuva after the changes take effect means you accept the updated Policy.

If you do not agree with the changes, you should stop using the Service and may request deletion of your account.
