These Terms of Service ("Terms") govern your use of the Nuva app and services provided by Nexus Kairos LLC ("Nuva", "we", "us", or "our"). By using Nuva, you agree to these Terms.

By creating an account or using Nuva, you agree to be bound by these Terms and our Privacy Policy. If you don't agree, please don't use our service.

Nuva is an AI-powered English learning app that provides voice-based practice sessions, real-time feedback, and personalized learning plans to help you improve your English speaking skills.

You must create an account to use Nuva. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

You must be at least 13 years old to use Nuva.

Nuva offers both free and paid subscription plans. Paid subscriptions are billed through the Apple App Store or Google Play Store according to their respective terms. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

We reserve the right to change pricing with 30 days' notice. Price changes won't affect existing subscriptions until renewal.

Cancellation and Refunds

You can cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of your current billing period.

Refunds are handled according to the App Store or Google Play refund policies. We don't provide direct refunds.

You agree not to:

• Use Nuva for any illegal purpose
• Attempt to access or tamper with our systems
• Share your account with others
• Copy, modify, or distribute our content
• Use automated tools to access our service
• Harass or abuse our support team

User Content

You retain ownership of your voice recordings and practice content. By using Nuva, you grant us a limited license to process your content solely to provide and improve our service.

We don't sell your content or use it for advertising. We may use anonymized, aggregated data for service improvements and research.

Nuva and all related content, features, and functionality are owned by Nexus Kairos LLC and protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from our app or content without our written permission.

AI-Generated Content

Nuva uses AI to provide feedback and learning content. While we strive for accuracy, AI-generated content may occasionally contain errors. The feedback is for educational purposes and shouldn't be considered professional linguistic advice.

We strive to provide reliable service but don't guarantee uninterrupted access. We may modify, suspend, or discontinue any part of Nuva at any time with reasonable notice.

We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity. You may delete your account at any time through the app settings.

Upon termination, your right to use Nuva immediately ceases, and we may delete your data per our Privacy Policy.

Disclaimer of Warranties

Nuva is provided "as is" without warranties of any kind, either express or implied. We don't warrant that the service will be error-free or that results will meet your expectations.

Limitation of Liability

To the maximum extent permitted by law, Nexus Kairos LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Nuva, including lost profits or data.

Our total liability shall not exceed the amount you paid us in the 12 months before the claim.

Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except you may assert claims in small claims court.
